Treatment is typically a part of someone’s sentence for drug related crimes. It is also part of the sentence if they commit another crime but are dealing with addiction. As far as less jail/prison time, no. Being high is not an excuse for your behavior.

If we did it right, we would go the route of Portugal and make possession of small amounts of drugs an arrestable offense, but we would put them in front of psychologists, counselors and doctors rather than a judge. This method has lead to a significant drop in substance abuse rates in their country.
